Terms of service
These terms are the agreement between you and Kinovate Ventures Inc. (“we”, “us”), which runs SiteBrite. They cover sitebrite.app, your dashboard, the editor, and the websites we host for you. We’ve written them to be read, not skimmed past.
Agreeing to these terms
You agree to these terms when you create an account, ask for a free preview or launch a site. SiteBrite is for businesses and other organizations. If you use it for a business, you agree for that business and confirm you’re allowed to. You must be at least 18.
Our privacy page says what we collect and why. It’s part of this agreement.
Your account
- You sign in with a link we email you, so keep your email account secure. You’re responsible for what happens in your account.
- If your account has editors, they can change its sites. Only the account owner can change billing.
- One account can hold several sites on one plan.
Plans and payment
- Each site costs $9 a month on the monthly plan, or $84 a year on the yearly plan. Add-ons, like the online store, are charged monthly on top. Current prices are on our pricing page.
- Converting an existing website costs a one-time $49 at launch on the monthly plan, and nothing on the yearly plan. Guided setup is free.
- Your plan renews by itself at the end of each month or year until you cancel. Stripe, our payment processor, charges your card.
- Prices don’t include sales tax where tax applies.
- If we change a price, we email the account owner at least 30 days before the new price applies, and it starts at your next renewal after that. You can cancel before then.
Credits, AI changes and work requests
- AI changes, work requests, and AI pictures beyond the free ones each month are paid from prepaid credits, which you buy from $20.
- You always see the price before you approve anything. An AI change is charged only when you publish it; if it fails or you discard it, it’s free. A work request is charged when it’s done.
- If something you paid for turns out to be our mistake, we put the credits back.
- Credits don’t expire while you have an account. They aren’t cash and can’t be moved to another account.
- When you close your account, we refund the credits you bought and haven’t used if you ask within 30 days of closing it. Write to help@sitebrite.app. Free and promotional credits aren’t refunded.
Canceling and refunds
- You can cancel your plan, or one site on it, any time from Billing in your dashboard. There’s no contract.
- Your site stays online until the end of the month or year you’ve paid for, then goes offline. We don’t refund part of a month or year, the conversion fee, or credits you’ve used, except where the law requires it.
- We keep a copy of a site for a year after it goes offline. Ask us within that year and we’ll put it back, or send you a copy.
If a payment fails
We email you and Stripe tries your card again over the next few days. Your sites stay online while you fix it. If a payment is still unpaid 14 days after it was due, we may lock the editor. After 30 days we may take your sites offline, and we keep them for a year as above.
Your content
- Your words, photos, logos, business details, and the messages and orders your site receives are yours. We claim no ownership of them.
- You let us store, copy, show, translate, back up and process your content, including with AI, only as needed to run SiteBrite for you: hosting your site, building previews, drafting and translating text, answering your support requests, and similar. This permission ends when we delete your content.
- You confirm you have the right to everything you upload or publish. When you ask us to convert an existing website, you confirm it’s your business’s site or that you have permission to copy its content.
- We don’t sell your content, and we don’t use it to train AI models.
Your site’s code
Your site is built from our website template, plus any sections made for you by AI changes or work requests. You may use, change and host your own site’s code anywhere, during and after your time with us, and give it to any developer to work on. You may not sell or give away the template itself as a product, or use it to build websites for other businesses. SiteBrite’s own service (the dashboard, the editor’s connection to it, AI tools and support) stays ours, and parts of your site that rely on it, like the editor, forms and the online store, stop working without it.
AI features
- AI drafts pages, writing, translations, pictures and changes for you. AI can get things wrong, so check what it makes before you publish. You’re responsible for what your site says.
- AI writing help in the editor is included in your plan within fair use. If use is far beyond what a small business’s site needs, we’ll talk to you before limiting it.
- You may use pictures AI makes for you on your site and anywhere else for your business.
The online store
Store payments go straight to your own Stripe account, under Stripe’s terms, and we take no cut. You’re the seller: your products, prices, sales tax, shipping, refunds and customer service are your responsibility, and we aren’t part of your sales.
Domains and other services
- Your domain stays registered in your name with your registrar. Keep it renewed: if it expires, your site can’t be reached at it.
- Services you connect to your site, like booking calendars, maps, newsletters and payment links, are run by other companies under their own terms.
Support
Support requests are free. Our assistant answers first. Billing, domain and canceling questions, and anything that’s our fault, reach a person at no charge. Other work by a person is a work request, priced before it starts.
What you can’t do
Don’t use SiteBrite to:
- break the law, or sell or promote anything illegal
- publish anything that infringes someone else’s copyright, trademark or privacy
- deceive people, including phishing, fake reviews and pretending to be someone else
- publish sexually explicit material, or content that harasses or threatens people or attacks them for who they are
- send spam, or spread malware
- overload, probe or get around the limits of our service, or resell access to it
If a site breaks these rules, we may take the content down or take the site offline, and we’ll tell you why unless the law or someone’s safety stops us. To report content that infringes your rights, email help@sitebrite.app.
Keeping the service running
- We work to keep your site online and backed up, but we can’t promise it will never be unavailable.
- We improve SiteBrite all the time and may change how it works. Before we remove a feature you pay for, we tell you at least 30 days ahead. If we ever stop running SiteBrite, we give at least 60 days’ notice and send you a copy of your site.
Ending this agreement
You can close your account any time. We may suspend or close an account that breaks these terms or isn’t paid, telling you first when we can. Sites closed this way are kept for a year, as above.
Warranties and liability
We provide SiteBrite “as is”, to the extent the law allows, without warranties beyond the ones in these terms. We aren’t liable for indirect or consequential losses, such as lost profits, lost sales or lost data. Our total liability for any claim is limited to what you paid us in the 12 months before it. Some places don’t allow these limits, and nothing here limits liability that the law says can’t be limited.
If someone makes a claim against us because of your content, your store’s sales or your breaking these terms, you’ll cover our reasonable costs of dealing with it.
Disagreements
- If you have a problem with us, email help@sitebrite.app first. Most things get sorted out that way. If they aren’t within 30 days, either of us can go further.
- Disputes are settled by binding arbitration, one person or business at a time, and not as a class action. The arbitration is run by a recognized arbitration provider under its rules, remotely or in Delaware. Either of us can use small claims court instead, for claims that qualify.
- These terms are governed by the laws of the State of Delaware.
- Where the law where you live gives you rights that these terms can’t take away, including the right to go to court there, you keep them.
Changes to these terms
When we change these terms in a way that matters, we email the account owner at least 30 days before the change takes effect. Using SiteBrite after that means you accept the new terms. The date at the top shows the latest version.
